Law360 (July 12, 2021, 5:09 p.m. EDT) – A Pennsylvania federal judge has denied an offer by the operator of three amusement parks in the Pittsburgh area to file a lawsuit alleging its mandatory mask guidelines related to COVID -19 the Americans violate the Disability Act, according to which the operator’s arguments can wait until a later point in the proceedings.
The unilateral order of senior U.S. District Judge David Stewart Cercone on Monday dismissed Palace Entertainment’s motion to dismiss the lawsuit brought by the families of several children with disabilities, without prejudice, saying the operator could raise its issues at the summary judgment stage of the litigation and now has 21 days to respond to families’ complaint ….
