With 7-yr expertise as attorneys, PwDs can get appointment to notary public’s put up | Jaipur Information

Jaipur: Now people with disabilities (PwDs) in the state can get an appointment as a notary public with just seven years of experience instead of ten years as a lawyer on the same pattern as the SC, ST and OBC benefits.
The State Legal Department had recommended that the Center make changes to the “Notary Rules” in this regard. A notice has been issued by the Ministry of Law and Justice in this regard.
In October 2019, based on the petition from Hemant Bhai Goyal, Divyang Adhikar Mahasangh’s national vice-president, the Court of the Commissioner for the Particularly Disabled issued an order instructing the Legal Department to submit proposals to the Center to amend the notary rules 5% reservation in the work of the notary for PwDs (people with disabilities) and to ensure relaxation of legal experience for them.
The notice from the Ministry of Legal Affairs, Ministry of Law and Justice states: “In exercising the powers conferred by Section 15 of the Notaries Act 1952 (53 of 1952), the central government hereby enacts the following rules to regulate the Act continue to amend Notaries Rules, 1956, namely: 1) (i) These rules may be referred to as Notaries (Amendment) Rules, 2021. (Ii) They enter into force on the day of their publication in the Official Journal. “
“2) In the 1956 Notarial Rules, in rule 3 after clause (ab), the following clause is inserted:” an individual with a benchmark disability within the meaning of Section (r) of Section 2 of the Rights of Individuals Under the Disabilities Act, 2016 ( 49 of 2016), who has been practicing as a lawyer for at least seven years, ”he added.
In another issue, the Human Rights Commission instructed the General Secretary and Legal Secretary to submit a factual report on the question of whether PwD attorneys should be given priority in the appointment of notaries. Goyal had filed a petition with the commission on the matter, urging that PwD attorneys should be given priority in appointing a notary.
In Rajasthan there are 1,500 notary posts under the central government quota and 2,000 posts under the state government quota.
