New York’s voluntary guidelines for ventilator use during a public health crisis have survived a challenge from disability rights groups because there’s no evidence they’re being enforced, a federal court said.
Not yet dead, NMD United, Disability Rights New York and four ventilator users lacked the right to sue New York officials for invalidating the guidelines as they face no imminent risk of injury, the U.S. District Court for the Eastern said District of New York.
Plaintiffs contested the validity of the ventilator allocation guidelines published in 2015 by a health service task force for the State Department of Health.
